Privacy Policy

The JobSarawak (hereinafter referred to as “our Website”, “JobSarawak”, “we”, “our” and “us”) is an online employment solution for talents (“Talents”) seeking jobs (“Jobseekers”) and employers (“Employers”) who need great Talents. We are a job advertising provider which offers an online platform for Employers to advertise their vacancies and attract local Talents. JobSarawak may also provide services offered by our advertisers (hereinafter referred to as “Advertiser”, “Third party”, “Partners”, “Employers” or “Merchants”).

All Jobseekers are free to use our online platform to search for suitable vacancies. Jobseekers will need to communicate and apply for the vacancies directly with prospective Employers. Jobseekers can use our resources to secure jobs (“Jobs”).

However, JobSarawak:
  • does not provide Jobs services for Jobseekers.
  • does not procure employment for Jobseekers.
  • does not offer to look for employment for Jobseekers.
  • does not offer employment for Jobseekers.
  • does not obtain employment for Jobseekers.
  • does not shortlist, select or appoint any Jobseekers for any Employers.
  • does not supply or look for an employee/workers for any Employers.
  • does not offer an employee or obtain an employee for any Employers.
  • does not charge or levy any fees from Employers for securing Talents.
JobSarawak’s privacy policy (the “Privacy Policy”) is intended to inform you of our policies and practices regarding the collection, use and disclosure of personal data (“Personal Data”) and information which you may submit to us through the use of our Website. It also sets out how we use, disclose and protect this data. “Personal Data” means any information relating to an identified or identifiable natural person, where an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, e-mail address, user ID, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person; and “process”, “processed” and “processing” means any operation, or set of operations, which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
This Privacy Policy applies to all Personal Data processed online by JobSarawak (regardless of how such Personal Data is collected). JobSarawak may collect such Personal Data through surveys, social media sites, websites, applications and domains or other platforms.
We may from time to time update, vary, amend or cancel some or all of this privacy policy and each time you visit our Website, or use our Services, you will be deemed to have accepted and to be legally bound by our updated or amended privacy policy.

    JobSarawak will only collect Personal Data about an individual which it reasonably considers necessary for the relevant purposes underlying such processing.
    Examples of your Personal Data which may be collected by us include the following:
    • Your name, gender, date of birth, telephone number, mailing address, electronic mail address, transaction details and any other Personal Data and information which you have provided to us in any forms you may have submitted to us or in other forms of interaction with you; and
    • Information about your usage of and interaction with our Website, including traffic data, location data, the originating domain name of your Internet service provider, statistics on page views, cookies and IP addresses.
    We use different methods to collect data about you, including; data that you voluntarily submit to us by registration on JobSarawak, or by corresponding with us by post, phone, email, chatbot or otherwise. We may also directly collect Personal Data in other ways, including when you carry out activities such as; using our Website, creating an account, contacting JobSarawak, signing up as member, subscribing to receive jobs updates, purchasing a job advertisement package, submitting your resume, submitting a content and/or posting content in discussion forums, entering a contest sponsored by us or our partners, filling out a survey, providing feedback/review, referring people to our service, requesting information about our services, submitting an affiliate agreement, applying for a job, posting a video or signing up for special promotions from third parties through JobSarawak.
  • Use and disclosure of Personal Data

      We use Personal Data to provide products and/or services to you through the activities you participate in, and in return, to improve the operation of JobSarawak, improve our marketing, product and service offerings, and your overall experience on our product and/or services. We may also use Personal Data to maintain and operate our website, e.g. sending emails, analyse data, provide marketing assistance, provide customer service, and assist in processing and fulfilling your orders, troubleshoot, resolve disputes, accomplish administrative tasks, administer our Website, analyse traffic, usage, trends, gather user demographic information, contact you, assist us in investigation or fraud prevention purposes; enforce our agreements with you, including our Terms of Use and this Privacy Policy, comply with applicable law, respond to governmental enquiries (or enquiries from a legal, governmental, Government-owned corporation or local authority agency or Internet protection agency of any type), cooperate with law enforcement activities, protect our rights or property, our Website, and/or other users of JobSarawak. We may also share Personal Data with our authorised third party service providers (including any person or organisation involved directly or indirectly with our business), Employers, partner merchants and advertisers at our discretion.
      It is optional for you to provide any Personal Data, resume or participate in these activities and if you do decide to participate, you may be asked to voluntarily supply Personal Data. However, if and when you do not wish to supply Personal Data or do not agree to our Privacy Policy, you must refrain from using or accessing our website immediately.
      Your data will be retained for the purposes for which it was collected and processed, or to comply with any legal, regulatory or internal requirements. We will take all reasonable steps to ensure that all personal data is destroyed or permanently deleted if it is no longer required for the purpose for which it was collected and processed.

    When you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to “”unsubscribe” by following the unsubscribe instructions provided in the promotional email you receive or by contacting us directly at admin.jobsarawak@sarawak.gov.my. Administrative Emails cannot be unsubscribed from; we will send you administrative emails regarding JobSarawak including, for example, job applications, administrative and transactional confirmations, and notices of updates to our Privacy Policy if we choose to provide such notices to you in this manner.
  • Security
    The Personal Data which we hold will be held securely within our systems and we will take reasonable precautions to safeguard your Personal Data. Please keep in mind that no information transmitted over the internet can be guaranteed to be 100% secure. We will endeavour to protect your Personal Data, however, we cannot ensure or warrant the security of any Personal Data you transmit to us or receive from us over the internet. Users acknowledge activities are conducted at your own risk. Once we receive your transmission, we will use our reasonable efforts to ensure its security.
    JobSarawak does not guarantee that your access to our Website would be uninterrupted, error-free or not terminated from time-to-time.

    If the need arises, we will obtain explicit consent from you before or when we process sensitive personal data (“Sensitive Personal Data”).   • Children and Minors Privacy Issues
    Children or minors under the age of 18 are not permitted to use JobSarawak. JobSarawak is not directed to children or minors under the age of 18, and we do not knowingly collect Personal Data from children or minors under the age of 18. If you are a parent or guardian of a child or minor under the age of 18, and you become aware that the child or minor has provided us with Personal Data without your consent, please contact us at admin.jobsarawak@sarawak.gov.my.     JobSarawak may provide areas on our Website where you can publicly post information or Personal Data about yourself, communicate with others on forums, blogs or discussion boards or blogs, reviews, profiles and services or submit media content. This information or Personal Data may be accessible by the public and may appear on other websites or web searches, and therefore this information or Personal Data could be read, collected, and used by others. We have no control over who reads your postings or what other users may do with the information you voluntarily post. It is your responsibility and decision to make sure you are comfortable with the information or Personal Data you choose to provide us and the information you choose to publish.

    Please note that this Policy forms part of the Terms and Conditions for use of JobSarawak and forms part of the Agreement between you and us. Your continued use of JobSarawak shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. Advertising Policy
  • Legislation
    Advertisements in JobSarawak must comply in every aspect of the law, common or statute and adhere to the Malaysian Code of Advertising Practice. It should not abuse the trust of the jobseeker or exploit their lack of experience or knowledge. All advertisements should be prepared with a sense of responsibility to the jobseeker. All advertisements should respect human dignity and should not incite or condone any form of discrimination including ethnicity, religion, gender, age, disability or sexual orientation.
  • General Principles
    All job advertisements should not contain anything that is inaccurate, false or misleading or contain elements which are forbidden under the law, by law, policies or regulations.
  • Advertisement Terms & Conditions
    JobSarawak, its affiliates and any of their respective employees, officers, shareholders, contractors, agents, Employers, Merchants, third-party or licensors, or any of their officers, directors, agents or users do not guarantee the timeliness, validity, completeness or accuracy of the content. Although we may update the advertisement on our websites from time to time, please note that you may come across user’s content that may be copyrighted material / harmful / inaccurate / misleading / not up-to-date information / typographical errors / offensive / threatening / indecent or objectionable including but not limited to explicit language and other potentially offensive materials. We do not endorse and are not responsible for any job advertisement information, opinion or statement contained therein. Some elements, information contained in any of the pages on our website may be reproduction of the employers seeking for jobseekers. You acknowledge that we shall have no liability with respect to such advertisement. Users can report these advertisements to us and we reserve the right to remove them from our website.
    JobSarawak may from time to time update, vary, amend or cancel some or all terms and conditions used for advertising purposes and each time the party visits our Website. By using our services, the party will be deemed to have accepted and to be legally bound by our updated or amended Terms and Conditions.
Digital Payment Policy
  • Payment
    You will be required to make payment for a job advertisement using a digital payment method made available to you. We may direct you to our trusted payment service providers’ websites, and you may be required to share with payment service providers your personal information such as name, address, identity card number, financial information (e.g. bank account, and etc) and any other information which is required by the payment service providers In order to complete the payment.
  • No Refund
    Notwithstanding anything to the contrary (but subject to any applicable law), all charges paid are non-refundable. However, if you believe that you have been charged in error or if you believe you should be refunded for any other reason, you should contact us within fourteen (14) days of such a charge. We reserve the right to refuse such a refund request for any reason, including if we reasonably believe that:
    • you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same feature;
    • if you are in breach of the Terms; or
    • if we reasonably suspect that you are using our Services fraudulently.

Kandungan Laman Web

JobSarawak (selanjutnya dirujuk sebagai "Laman Web kami," "JobSarawak," "kami," dan "kita") adalah satu penyelesaian pekerjaan atas talian bagi calon-calon ("Calon") yang mencari pekerjaan ("Pencari Pekerjaan") dan majikan ("Majikan") yang memerlukan calon terbaik. Kami adalah pembekal pengiklanan pekerjaan yang menawarkan platform atas talian kepada Majikan untuk mengiklankan kekosongan mereka dan menarik Calon tempatan. JobSarawak juga mungkin menyediakan perkhidmatan yang ditawarkan oleh pengiklan kami (selanjutnya dirujuk sebagai "Pengiklan", "Pihak Ketiga", "Rakan", "Majikan", atau "Peniaga").

Semua pencari pekerjaan adalah bebas untuk menggunakan platform dalam talian kami untuk mencari kekosongan yang bersesuaian. Pencari pekerjaan perlu berkomunikasi dan memohon pekerjaan secara langsung dengan majikan yang berpotensi. Pencari pekerjaan boleh menggunakan sumber-sumber kami untuk mendapatkan pekerjaan ("Pekerjaan").

Tetapi, JobSarawak:
  • Tidak menyediakan perkhidmatan pekerjaan untuk pencari kerja.
  • Tidak mendapatkan pekerjaan untuk pencari kerja.
  • Tidak menawarkan untuk mencari pekerjaan untuk pencari kerja.
  • Tidak menawarkan pekerjaan untuk pencari kerja.
  • Tidak memperoleh pekerjaan untuk pencari kerja.
  • Tidak menyenarai pendek, memilih atau melantik mana-mana pencari untuk mana-mana majikan.
  • Tidak membekalkan atau mencari pekerja untuk mana-mana majikan.
  • Tidak menawarkan pekerja atau memperoleh pekerja untuk mana-mana majikan.
  • Tidak mengenakan atau memungut sebarang yuran daripada majikan untuk mendapatkan bakat.
Dasar privasi JobSarawak (selanjutnya dirujuk sebagai "Dasar Privasi") bertujuan untuk memaklumkan anda tentang dasar dan amalan kami mengenai pengumpulan, penggunaan dan pendedahan data peribadi ("Data Peribadi") dan maklumat yang mungkin anda serahkan kepada kami melalui penggunaan laman web kami. Ia juga menetapkan tentang bagaimana kami menggunakan, mendedahkan dan melindungi data ini. Dasar Privasi ini terpakai kepada semua data peribadi yang diproses secara dalam talian oleh JobSarawak (tidak kira bagaimana data peribadi tersebut dikumpulkan). JobSarawak boleh mengumpul Data Peribadi tersebut melalui tinjauan, laman media sosial, laman web, aplikasi dan domain atau platform lain.
Kami mungkin dari semasa ke semasa mengemas kini, mengubah, meminda atau membatalkan sebahagian atau semua dasar privasi ini dan setiap kali anda melawat laman web kami, atau menggunakan perkhidmatan kami, anda akan dianggap telah menerima dan terikat secara sah oleh dasar privasi kami yang telah dikemas kini atau dipinda.
  • Pengumpulan Data Peribadi
    JobSarawak hanya akan mengumpul Data Peribadi tentang individu yang dianggapnya wajar perlu untuk tujuan yang berkaitan dengan pemprosesan tersebut.

  • Penggunaan dan Pendedahan Data Peribadi

      Kami menggunakan Data Peribadi untuk menyediakan produk dan/atau perkhidmatan kepada anda melalui aktiviti yang anda sertai, untuk meningkatkan operasi JobSarawak, pemasaran, produk dan tawaran perkhidmatan kami, dan keseluruhan pengalaman anda pada produk dan/atau perkhidmatan kami.   • Akses ke Data Peribadi
    Kami berusaha untuk mengekalkan data peribadi yang lengkap, terkini dan tepat tentang anda. Sebarang data peribadi yang tidak tepat yang dibawa kepada perhatian kami akan diperbetulkan secepat mungkin selepas pemberitahuan. Prosedur akan dikekalkan untuk memastikan bahawa sebarang ketidaktepatan yang dilaporkan akan ditangani dengan segera dan berkesan serta semua data peribadi akan kekal selamat, terkini dan lengkap.

      • does not shortlist, select or appoint any Jobseeker for any Employers.
      • does not supply or look for an employee/workers for any Employers.
      • does not offer an employee or obtain an employee for any Employers.
      • does not charge or levy any fees from employers for securing Talents.

    • Conditional use of our Website and Services
      Your permission to use JobSarawak is conditioned upon your agreement that you:

      • are solely responsible for your User ID, passwords and the activity that occurs while signed in to JobSarawak account;
      • will not copy or distribute any part of JobSarawak in any medium without our prior written authorisation;
      • will not use JobSarawak to collect any personally identifiable information, including account names, email addresses, or other such information, for commercial purposes;
      • will not use the communication systems provided by or contacts made on JobSarawak for any commercial solicitation purposes;
      • allow JobSarawak permission to send administrative, site updates and promotional emails to you.
      • grant JobSarawak a royalty-free, perpetual, worldwide, irrevocable, non-exclusive licence to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sub-license such rights through multiple tiers of sub-licensees on any communications, postings on or through JobSarawak.
    • Password and Security
      When you register to use the JobSarawak website, you will be asked to create a password. To prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password, you should notify JobSarawak by contacting JobSarawak immediately.
      If we have reason to believe that there is a potential breach of security or misuse of the Website, JobSarawak may require you to change your password, or we may suspend your account. As a result of your loss of your password or the misuse of the Website:
      • all losses or damage incurred thereby shall be borne by you; and
      • you shall fully indemnify JobSarawak should JobSarawak suffer any loss or damage.
      JobSarawak will not be responsible for any loss and/or damage suffered by you due to unauthorised usage or misuse of the password.
    • Additional Conditions Applicable to Employers
      Employer warrants that any employer content (“Employer Content”) provided to be used in connection with any services provided from the Website will not violate any laws or regulations or third-party proprietary rights, including, without limitation, copyright, trademark, obscenity, rights or publicity or privacy, and defamation laws.
      Employers agree that it shall disregard any personal data received from the candidate which are irrelevant to obtaining and assessing the suitability of candidates.
      JobSarawak does not allow any Employer Content on the Website that requests candidates to pay any kind of fees including deposits, placement and processing fees and purchasing fees.
      JobSarawak is not obliged to monitor the Employer Content but may monitor the Employer Content randomly.
      JobSarawak’s resume database is to be accessed and used solely by Employers and you shall not disclose any of the data to any third party, unless authorised to do so by JobSarawak for employment purposes.
      You shall take necessary measures to protect the data you have obtained from JobSarawak’s resume database from loss, misuse, unauthorised access, disclosure, alteration or destruction.
      Employers shall not use JobSarawak’s resume database for any other purpose except as an employer and/or on behalf of an employer seeking employees.
      All vacancies posted are solely for the positions located within the Malaysian states.
      All private employment agencies must hold a valid licence under the Private Employment Agencies Act 1981 [Act 246] to carry on recruiting activity at all material times.
      All private employment agencies must be authorised by the Employer before posting any vacancies on behalf of the Employer.
    • Additional Conditions Applicable to Jobseekers
      All information provided by you in the Website shall be disclosed by JobSarawak to prospective Employers.
      JobSarawak reserves the right to delete your account and all your information after a significant duration of inactivity.
      Jobseekers must exercise caution and assume all risks dealing with employers listed on the Website as JobSarawak does not screen or censor the listings and is not involved in the actual transaction between Employers and Jobseekers.
    • Disclaimer
      To the fullest extent permitted by law, JobSarawak, its affiliates and any of their respective employees, officers, shareholders, contractors, agents, Employers, Merchants, third party or licensors, or any of their officers, directors or agents, exclude all conditions and warranties implied by custom, law or statute.
      • Geographic Disclaimer
        Access to the Website and the content (“Content”) as well as the terms of our Privacy Policy may not be legal for some persons or in some countries outside Malaysia.       JobSarawak, its affiliates and any of their respective employees, officers, shareholders, contractors, agents, Employers, Merchants, third party or licensors, or any of their officers, directors or agents will not be liable or have any responsibility of any kind for any losses, damage or destruction of data, including, without limitation, breach of contract by employee, dissatisfaction of an employee’s performance and/or services or losses you incur in the event of any failure or interruption of our Website or our equipment, or resulting from the act or omission of any other party involved in making our Website and/or any JobSarawak services made available to you or collecting the data contained therein, or from any other cause relating to your access to or your inability to access our Website.

      JobSarawak provides customers with job advertising services. By placing an order for the job advertising through JobSarawak, you make an offer to procure our advertising service including the terms, restrictions and conditions associated with the advertising. You are encouraged to read through all information, including all fine terms set out in the webpage before purchasing. Should you have any queries, please email JobSarawak at admin.jobsarawak@sarawak.gov.my before making your purchase to clarify.
      • The fee for job advertisement is in Malaysian Ringgit.
      • All payments must be made before any form of advertisements can be activated and/or published. All paid invoices shall be processed within 7 working days after proof of payment slip is received.
      • Each job posting is considered an advertisement where the job is advertised online on Job Sarawak for a Thirty (30) day period.
      • Each Job posting should contain one position only; no combination of other positions will be allowed in a single job post.
      • JobSarawak may accept or reject your offer to promote Job advertising.
      • JobSarawak reserves the right to suspend any aspects of its service without refund in the event of non-compliance by the Advertiser on our Terms of Use;
      • All content of job advertisements are subject to JobSarawak’s approval. JobSarawak reserves the right to cancel any advertisement at any time for any reason whatsoever.
      • Advertiser agrees that JobSarawak can use its name in all advertisements and campaigns (including but not limited to online media, email blast, print media, outdoor ads, radio, website ads, etc.) to promote the Advertiser’s job openings.
      • All promotional rates, fees or charges stated herein are valid for 7 days upon the receipt of the signed Sales Agreement Form; and are subject to change without prior notice.
      • Cancellation, termination, extension or refund will not be granted upon submission of this signed agreement.
      • You must be of legal age to form a binding contract. You must be at least 18 years old to be eligible to use the Site or purchase any Job advertising service. However, if you are at least 13 years old but not yet 18, you may use the Site in conjunction with your parent or guardian above age 18 who agrees to this Agreement. No one under the age of 13 years old may use our Website.
    • Returns and Refunds
